However, it’s important to note that this guarantee is subject to certain limitations and conditions. This document outlines the terms of our 100% Approval Guarantee and its limitations. Please read it carefully to understand your rights and obligations under this guarantee.

1. Refund of Fees: In the event that the immigration application submitted by the actual applicant is denied solely due to errors on the part of Immigrant Nation in the preparation or submission of the application, both the fees paid to us for our services and the fees paid to USCIS will be refunded in their entirety. The refund shall be the sole remedy available to the actual applicant.
2. Exclusions This guarantee does not cover denials or delays resulting from factors beyond our control, including but not limited to changes in immigration law, inaccurate or incomplete information provided by the client, or the client’s failure to comply with USCIS requirements.
3. Refund Process: To qualify for a refund, the applicant must provide us with a copy of the USCIS denial letter within 30 days of receiving it. We reserve the right to request additional information from the applicant regarding the basis for the denial before issuing a refund. Once the verification process is complete, we will process the refund within 60 days.
4. Non-Transferability: The Approval Guarantee refund is only available to the actual applicant whose name appears on the denied application. It is not transferable to any third party.
5. Waiver of Claims: By accepting this guarantee, the applicant knowingly waives any and all claims, known or unknown, against Immigration Nation/USA Path beyond the refund of the fees paid for our services and USCIS fees.
6. ArbitrationL Any disputes or claims that stem from or relate to the 100% Approval Guarantee, including any breaches, will be resolved through arbitration. This process will be managed by the American Arbitration Association following their Commercial Arbitration Rules. The judgment given by the arbitrator(s) can be enforced in any court that has appropriate jurisdiction
7. Governing Law: This guarantee shall be governed by and construed in accordance with the laws of the state of Washington.
8. Waiver of Litigation: By accepting this guarantee, the applicant waives the right to litigate any dispute arising from or related to this guarantee in court, except as necessary to enforce the arbitration agreement or any resulting arbitration award.
9. Severability: If any provision of this guarantee is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. Amendments: Immigrant Nation reserves the right to modify the terms and conditions of this guarantee at any time. Any such modifications shall be effective upon posting on our website, and the applicant’s continued use of our services after the modification constitutes acceptance of the amended terms and conditions.
11. Attorney Fees: In the event of any legal action to enforce this guarantee, the prevailing party shall be entitled to recover reasonable attorney fees and costs from the non-prevailing party, in addition to any other remedies available.
12. Limitation of Liability: Except for indemnification obligations, breach of confidentiality, or the gross negligence or willful misconduct of either party, neither party shall be liable to the other or any other person for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to this guarantee.
13. Limitation of Remedies and Damages: The customer’s exclusive remedy and our maximum liability for any losses, damages, costs, expenses, or claims arising out of or in connection with the services provided under this guarantee, whether based in contract, tort, or any other legal theory, shall not exceed the total amount of fees paid by the customer for the service. The customer hereby waives any right to any other remedy, whether in law or in equity, including but not limited to indirect, special, incidental, consequential, punitive, or exemplary damages, or any damages for lost profits, lost savings, or loss of data.
14. Release of Obligations: By accepting this guarantee, the customer releases Immigrant Nation from any and all obligations, liabilities, and claims beyond the limitations set forth in this clause.
